LLC Name Availability
An LLC name that is “available” in your state database is not necessarily usable. A state filing office only checks whether another LLC in the same state already registered the exact name. It does not check domains, social handles, or trademarks — and those are the three that force rebrands.

- State registry: Search your Secretary of State business entity database for the exact name and close variants. Every state has its own portal — search for “[your state] Secretary of State business entity search.” If the exact name is taken in your state, pick another name or a distinguishable variant.
- Domain: Is the .com free? If not, can you get a clean variant (get-, try-, + studio / supply / co)? Customers type .com from memory — a taken .com is a daily leak.
- Social handles: Can you claim the same handle on Instagram, TikTok, YouTube, and X? Mismatched handles confuse customers and hurt search.
- Trademark: Is a similar mark already filed in your category? A state approval does not protect you from a federal trademark claim. This is the expensive one.
What “available” means in each system
- State registry: No other entity in the same state holds the same or a confusingly similar name. Approval here is a filing decision, not a trademark clearance.
- Domain: The registry has no record for that .com right now. First-come, first-served — register the same day you decide.
- Handles: The handle is unclaimed on each platform. Platforms do not check trademarks for you.
- Trademark: No conflicting mark in your goods/services classes. Only this one keeps you from getting a takedown letter.
Common trap: “My state approved it, so I am safe.” State approval and trademark rights are separate systems. A business in another state can hold a federal trademark that blocks your name nationwide, even after your LLC is approved.
LLC naming rules to remember
- Most states require an LLC designator — LLC, L.L.C., or Limited Liability Company — at the end of the legal name. Your brand name can be shorter, but the filed name must include the designator.
- Most states reject names that imply you are a bank, insurer, or government agency unless you are licensed for that activity.
- Do not use a famous brand with one letter changed (“Nikea LLC”). State systems may approve it; trademark law will not protect it.
- If you plan to operate in more than one state, check each state separately. Availability in one state does not guarantee availability in another.
How to check in 30 seconds
- Search your state entity database for the exact name.
- Run the same name through the NameCheck homepage with your category — domain + handles + trademark pre-screen in one pass.
- If any of the four checks fails, take one of the 12 ranked alternatives on your results page. Each has a one-tap .com re-check.
- When one clears all four, file the LLC, register the .com, and claim the handles the same day.
FAQ
Does state approval mean my name is trademark-safe?
No. State filing offices check state entity names only. Trademark rights are federal and use-based. Always run a trademark pre-screen before you print packaging or signage. See How to Check If a Name Is Trademarked.
Can two LLCs have the same name in different states?
Often yes — states check only their own registry. But a federal trademark holder can still object to your use nationwide, regardless of state. That is why the trademark check matters more than the state check.
Should I check the DBA / trade name too?
Yes. If your brand name differs from your legal LLC name, check the DBA (doing business as) name the same way — state DBA registry, domain, handles, and trademark.
What does the $9 report add?
The free check gives you the live verdict. The $9 one-time Clearance Report packages it into a keepable document: domain verdicts across 6 TLDs with sources, handle checks, trademark pre-screen, 12 ranked alternatives, filing classes, and a next-step checklist.
