DBA Name Availability

A DBA — "doing business as," also called a fictitious business name, trade name, or assumed name — lets you operate under a name that is not your legal entity name or your personal name. Before you print the cards or buy the domain, you need to know whether the DBA name is actually available.

DBA availability is three separate checks

  1. County level: most DBA registrations happen at the county clerk's office. The county checks whether that exact name is already registered in the county — that is the official gate, but only the county's gate.
  2. State level: your secretary of state's business database covers LLCs and corporations — a separate question from DBA availability. An LLC with the same name in your state is a red flag even if the county would register your DBA.
  3. Trademark level: a USPTO pre-screen checks whether the name conflicts with a live federal mark. County registration does not check this — you have to do it yourself. This is general information, not legal advice.
  4. Domain and handles: the county does not care whether someone owns the .com. Check domains and social handles before you file, or the brand may be unusable online.

How to check a DBA name's availability

  1. Search your county clerk's DBA or fictitious name records — many counties offer an online name search; some require a visit or a phone call.
  2. Search your state business database — it answers whether the legal entity name is taken in your state.
  3. Run a USPTO pre-screen — a live trademark in the same industry usually means picking a different name, registered DBA or not.
  4. Check the domain and social handles — an unavailable .com or taken handles won't block your DBA filing, but they can make the brand unusable online.

When a DBA is enough — and when you need an entity

FAQ

Is a DBA the same as an LLC?

No. An LLC is a separate legal entity formed with the state; a DBA is just a registered name for an existing business or sole proprietor. Many LLCs also register DBAs when they trade under more than one brand name.

Does a DBA protect my business name?

Only at the level you filed it. A county DBA does not stop anyone in another county or state from using the same name, and it does not block a trademark. For broader protection you need a trademark registration. This is general information, not legal advice.

Can two businesses have the same DBA name?

In different counties, sometimes — see our full answer on when identical names can coexist. Within the same county, the clerk will reject a duplicate filing.
